Understanding K-1 Visas

Also known as fiancé visas, K-1 visas allow a U.S. citizen to sponsor their foreign national fiancé for lawful residency. The sponsor in this relationship must submit a Petition for Alien Fiancé, which kicks off the visa process. After the approval, you and your fiancé will have 90 days to get married or else the visa will expire. After the marriage, the foreign national fiancé will be able to apply for a green card. 

An important note: you and your fiancé will be interviewed to determine that your relationship is legitimate–faking a relationship for a visa or green card is illegal and could result in penalization. 

Qualifying For A K-1 Visa

There are many steps in the process to obtaining a K-1 visa, and our Fruit Cove fiancé visa attorneys are qualified to help you throughout your journey. In order to obtain your visa, you will need to complete the following steps: 

• The U.S.-based fiancé must act as sponsor.
• The relationship must be legitimate.
• Any previous marriages must be dissolved.
• In order to qualify, the couple must have at least one in-person meeting in the two years before filing the application.
• Evidence that the U.S.-based fiancé has an income 100% above the poverty level must be submitted for verification.
• Submit the required documentation, including of the above.
• You will have a meeting with a consular officer to determine your overall eligibility.
• Within 90 days of your application, you need to get married, after which you can begin the pursuit of a green card.
